MT Legal Services believe that everyone should have a carefully structured plan for how they wish to distribute their assets following their death. The only way to ensure that your wishes are known and followed, is by writing a carefully and correctly drafted Will.
The following represent just some of the many reasons why you should have a Will:-
- By having a Will you can ensure that your spouse/civil partner will receive all of your estate. This is NOT automatically the case if you die without a Will.
- By having a Will you can ensure that if you are not married, your partner will benefit. Without a Will and irrespective of how long you have lived together as man and wife, your unmarried partner will not benefit from your estate at all.
- By having a Will you are able to appoint guardians for your minor children.
- By having a Will you are able to control the release of money to your children until you think they are old enough to handle large sums of money.
- By having a Will you may benefit charities, friends and distant relatives who otherwise would not inherit.
- Thousands of homes are sold each year to fund Long Term Care needs. This can be avoided through prudent planning within your Wills.
- Although changes in Inheritance Tax (IHT) legislation have made it easier for married couples to leave their estate without paying IHT, unmarried couples and those with large business assets, should take advice to ensure they maximise their IHT saving potential.
